Dialogue Processes: An Applicable Method for Reunification after Care Orders?

A central aspect of the chapter is the introduction of dialogue processes in the Child Welfare Tribunals, as a dialogue-based approach aiming to find common solutions between the child, parents and the Child Welfare Service. The method is primarily used in severe cases where care orders are a likely outcome. The Norwegian context is presented, offering insights into the reproach by the European Court of Human Rights of the Child Welfare System for its shortcomings in facilitating reunification after a care order. We explore the potential of dialogue processes in navigating the complexities of reunification cases when children are returned home after compulsory out-of-home care. By presenting nuanced perspectives and addressing challenges, the aim is to provide an understanding of the dialogue processes’ strengths and limitations within the specific context of reunification cases. The chapter points to how central elements from mediation theory may be particularly prominent in a reunification process, especially concerning restorative practice.
