On the Possibility of a Bioethics Based on Fundamental Rights

摘要

This work defends the possibility of a bioethics based on fundamental rights as an alternative to principlism. To do this, it is necessary to have a theory of fundamental rights in which these do not allow themselves to be harmed or restricted through the principle of proportionality, which is the dominant conception today. The delimitation of the content of each fundamental right and the regulation of its exercise in the real framework that contextualizes it constitute the most relevant tasks when it comes to solving practical problems in which fundamental rights are present. The chapter pays particular attention to the fundamental right to physical integrity within the framework of the Spanish constitutional system to show what the approach to a fundamental rights-based bioethics should be.
