Implementation of the European Court of Human Rights Judgements as an Instrument for Recovery of Ukraine and its Accession to the European Union

The chapter focuses on the potential role of implementation of the European Court of Human Rights (ECtHR) judgements in Ukraine’s recovery and accession to the European Union. It first analyses pre-February 2022 challenges in implementation of the ECtHR judgements in Ukraine. It then evaluates the impact of the invasion on the implementation of the ECtHR judgements, particularly within the framework of Ukraine’s aspirations for EU accession and the recovery plan encapsulated in the Ukraine Recovery Plan. Finally, it explores the interrelations between enforcement of the ECtHR judgements in inter-State cases against Russia and establishing a special mechanism of compensation for human rights violations caused by Russian aggression.
