State Constitutional Courts and “Militant Democracy”

摘要

As highlighted in Chap. 4 , German constitutional courts can be understood as an “institutional response” to authoritarian or totalitarian regimes: if necessary, they should have the means to defend constitutional democracy. In this chapter, I will examine whether also state constitutional courts can make democracy “resilient” even in the event of a non-democratic party seizing power.
