Grounded in the constitutional framework outlined in Article 10(1), this chapter explores the fundamental significance of freedom of speech and expression in fostering democratic principles while acknowledging its non-absolute nature. It examines Malaysia’s historical development and legal landscape, scrutinising laws that may impose limitations on free expression and drawing parallels to restrictions present in other democratic jurisdictions.
