Understanding Patents: Historical and Legal Aspects

摘要

This chapter deals with the multifaceted realm of patents, shedding light on their historical evolution and the legal foundations that underpin modern patent systems. The short history of patents reveals their origin in medieval Europe, where monarchs granted exclusive rights to inventors as incentives for innovation. Over centuries, these rudimentary systems evolved into the robust and complex patent systems we know today. The legal foundations of these systems are explored, emphasizing their role in promoting innovation by providing inventors with a temporary monopoly in exchange for full disclosure of their inventions. The chapter dissects the procedural aspects of patent registration, elucidating the rigorous examination process that ensures patents meet the criteria of novelty, non–obviousness, and utility. Substantive issues of patent law are also examined, emphasizing the protection of inventions and the rights and responsibilities of patent holders, i.e., the scope and limitations of patent protection. Altogether, this chapter equips readers with a holistic understanding of patents, their historical context and origine, and their crucial role in driving technological progress and economic development.
