A Psychological Approach to Contractual Mistakes

The fact that German scholars put more emphasis on what the declarant wanted to express with his declaration of intent rather than what the objective third-person understood, the former being the approach in English law, indicates that German law gives more space to psychological consideration of legal phenomena than its English counterpart. This is the reason why this chapter will analyse the approach taken in German literature, as it presents important research value for further discussion on mistakes made by AI in contract formation.
