Assertiveness as a Human Right: Its Configuration from the Dignity of the Person in Situations of Vulnerability

There is no legal literature on assertiveness from Mexico’s human rights perspective. This exploratory research proposes that human dignity is the starting point for any human being to be recognised as a person. This inherent quality of all people, just for the fact of being a person, is not a metaphysical or abstract characteristic but has had a development from the constitutional culture and human rights to such a degree that it becomes a fundamental piece for the socio-legal scaffolding of any projection and materialisation of the rights of people in situations of vulnerability. There are certain vulnerable groups in this country, such as street girls and women, women living in conditions of extreme violence, migrants and members of the LGBTQ+ group, and persons with disabilities, older persons, indigenous persons, people of African descent, to name a few, who are in urgent need for the recognition of their dignity as human beings and the rights inherent therein.
