Ordinary Weapons for Exceptional Threats? Infringement Procedure and Rule of Law Crisis

The infringement procedure has been acquiring a prominent role in facing the rule of law crisis, although it has initially been considered unfit for such systemic threats. The solid background of its practice, the leverage granted by fines and the lack of political filter are all pros supporting its application in such context. The recent practice related to Poland also showed the reference to the violation of the democratic principles, opening a new scenario for their promotion within the EU.
