The current landscape of Comparative and International Law demonstrates a focus on examining inclusive and complex identities from multiple perspectives. In Comparative Law, examples include the Comparative International Law movement and the TWAILs’ Decolonising School. Similar considerations pertaining to constitutional law are present in emerging schools of International Law, which aim to influence the global order through concepts such as ius cogens. As a result, there is an identified need to develop new concepts of Law that address the construction of relational subjectivity. Additionally, the development of this relational identity is regarded as being closely connected to Esposito’s concept of communitas.
