Defining “Next-Gen Negligence”

In Chap. 2 the authors discussed traditional negligence and how negligence arises in the public school setting. Now, Chap. 5 aims to refocus thinking about negligence from more traditional or expected cases, such as premises liability, bullying, and discrimination cases, to current hot topics in education law as seen in recent U.S. Supreme Court decisions and arising in school districts across the country. The authors introduce what they are calling “next-gen negligence.”
