Next-Gen Negligence and Students’ Unique Learning Needs

Chapter 10 shifts the focus from examining a public school student body as a whole to taking a closer look at the duties public school employees owe students with unique learning needs. Looking again at court decisions with which, by this point, readers should be readily familiar, the authors examine how and when an administrator may be exposed to liability for negligence with respect to meeting the needs of each and every student in the district. By further examining cases such as Peter W., the authors engage the readers in a discussion of when such liability may attach and how administrators and other employees may be protected from liability with respect to addressing students’ unique learning needs.
