Concluding Remarks: The Judiciary—A Privileged, Nepotistic, and Formalistic Institution?

This book has been dedicated to scrutinizing the judiciary from an internal perspective and illuminating whether judges constitute a traditionalist and formalistic elite, or whether they are equipped to safeguard rights and restrain the tyranny of the majority. The judiciary in Mexico have the institutional conditions to do so and this book examines whether judges have or do not have the profiles, ideas, beliefs, and values to advance rights or limit the government. This is of utmost importance, particularly in contexts where attacks on court decisions and their independence have begun to spread. The primary contribution of this work lies in its provision of original data on aspects that include judges’ social backgrounds, professional paths, careers, judicial governance, and, notably, their legal culture.
