The Reasons for and Methods of Recognising Aggravated Sex Trafficking as a (Jus Cogens) Crime Against Humanity

摘要

This chapter considers how and why aggravated sex trafficking is, and should be treated as, a peremptory norm subject to universal jurisdiction, and the chapter culminates in a model of six Ds (6D model) for considering the jus cogens content of the offence. Although we must not get stuck in the past, relating what is new to what we know and have already experienced is helpful. So, the chapter engages with relevant literature and jurisprudence in a broadly legal historical approach to shape the development of the 6D model, which conceptualises the jus cogens elements of contemporary Albanian sex trafficking through comparisons to genocidal war rape.
