Towards Efficacy: Between the Legal Uncertainty of the Requirement of Consultation and Its Most Adequate Application for Brazil

Worldwide, indigenous peoples are being affected by activities of natural resource exploitation in their territories. In the aftermath of the era of colonization, indigenous peoples continue to not hold entitlement for the territories they have occupied for centuries. Compounded by the fact that indigenous peoples represent minorities in contemporaneous states, these territorial conflicts are marked by both legal and illegal activities.
