Transcendental Law and Legal Reform in the Digital Era

This study aims to examine the contribution of the concept of transcendental law to addressing legal gaps in Indonesia, offering a wider perspective on how the law can be directed towards achieving higher and more abstract objectives such as justice, effectiveness, sustainability, and fairness. Transcendental law is a legal principle that focuses on laws transcending the material and temporal worlds. In the context of converging legal thinking, transcendental law can help reach consensus and shared understanding in addressing legal gaps. In restructuring and transforming the legal system, transcendental law can guide changes that aim to achieve broader goals, such as justice, sustainability, and effectiveness. In the digital era, transcendental law can assist in developing a comprehensive regulatory framework that includes aspects such as privacy, data security, and copyright, while taking into account abstract values such as justice and sustainability. This study uses a literature review methodology and presents recommendations for legal reform in Indonesia. Overall, transcendental law provides a comprehensive outlook on how the law can be directed towards achieving larger and more abstract goals, contributing to legal reform in Indonesia.
