Substantive Criminal Law in the Normative Approach

Criminal law describes the criteria for holding an offender criminally responsible. Such criteria, when interpreted in a specific case, should form an unambiguous, coherent and clear directive of conduct—penal norm. This chapter describes the underlying assumptions of the normative view of criminal law, explaining the concept of penal norms. In doing so, it provides a theoretical foundation for further considerations.
