The Making of Criminal Law as an Element of Ius Puniendi

摘要

The creation of criminal law regulations is part of the exercise of ius puniendi, which in turn is considered to be an exclusive competence of the state. At the same time, however, law-making is increasingly conditioned by the content of international law. This chapter presents possible points of interference by the statements of international non-state actors on the content of domestic criminal law.
