Property Rights and Democratic Decision-Making: Lessons from the 1922 Constitution

This chapter analyses the lessons that can be taken from the drafting of the 1922 Constitution for current-day constitutional property dilemmas. In particular, it examines alternative strategies for mediating between property rights protection and democratic decision-making that are highlighted by the 1922 experience and which signal different constitutional pathways for addressing contemporary housing and environmental challenges.
