Reconciling the Freedom of Expression with the Right to Privacy: Protecting Private Life from Media Invasions Under the ECHR

This chapter embarks on an exploration of reconciling the freedom of expression with the right to privacy within the framework of the European Convention on Human Rights (ECHR). It commences by providing an overview of illustrative cases demonstrating the protection of privacy under the Convention, establishing the relevance of the ECHR as a model for privacy protection. This chapter delves into the background and establishment of the ECHR, emphasizing the impact mechanism of ECtHR case-law in national jurisdictions. It further elucidates the nuances of Article 8 of the ECHR, which safeguards privacy rights, outlining the meanings and scopes of private life, home protection, and correspondence within this context. A crucial aspect of this exploration lies in the balancing act between privacy and countervailing rights, with a specific focus on freedom of expression under Article 10 of the ECHR. Drawing from prominent media-related cases and leading judgments on celebrities and paparazzi, especially the Von Hannover series of cases and Axel Springer AG v Germany, the chapter examines the principles and criteria established by the ECtHR for this intricate balancing exercise. It also highlights illustrative judgments addressing invasive media practices and emphasizes the limitations imposed on journalistic enterprises under the ECHR. In summary, the chapter underscores the research premise that the ECHR’s protection of the right to privacy, harmonized with the right to free speech, offers a robust model for comparative studies. The rich jurisprudence of human rights within this framework provides valuable insights for addressing privacy challenges related to media practices in Pakistan. The discussion aligns with the conclusions drawn from the conceptual framework in Chap. 3 , emphasizing the fundamental nature of privacy, the necessity for context-specific legal protection, and the imperative role of balancing techniques in resolving conflicts between free speech and privacy, guided by principles of proportionality and justification of interference. In the quest to look elsewhere for guiding principles, this chapter sets the stage for a comprehensive examination of privacy protection mechanisms in the national jurisdictions through comparative studies and offers a solid foundation for prescriptive recommendations in the subsequent phases of the research.
