Right to Privacy and Freedom of Expression in the Constitution of Pakistan

This chapter explores the constitutional landscape governing the right to privacy and freedom of expression in Pakistan, offering critical insights essential to the research’s overarching objectives. Pakistani courts have interpreted expressions like “protection of a person’s life,” “human dignity,” and “privacy of the home” liberally, prioritizing the safeguarding of these values over linguistic intricacies. This broad interpretation aligns seamlessly with the conceptual framework established in preceding chapters, providing a solid foundation to counter narrow terminological expressions. A pivotal feature of fundamental rights enforcement in Pakistan is its horizontal effect, meaning these rights apply not only against the state but also against private individuals and entities. This aspect allows for the extension of the conceptual framework to address privacy rights breaches by private parties, including journalists and media outlets. While Pakistan’s Constitution enshrines the right to free speech and media freedom, it imposes limitations to protect communal and public interests. However, the analysis underscores the absence of clear guidance on balancing free speech against private interests, especially when speech involves private information. This gap emphasizes the need for well-defined privacy protection principles. The examination of the constitutional regime for safeguarding privacy interests reveals a significant practical deficit, leaving individuals with minimal protection. To address this, the chapter calls for urgent attention from policymakers to establish a comprehensive privacy law that can effectively address privacy infringements. This recommendation is reinforced by insights from international jurisdictions in the forthcoming chapters that have successfully navigated the complexities of reconciling free speech and privacy, serving as valuable references for the formulation of privacy protection mechanisms in Pakistan.
