Corporate Climate Liability

The ruling of the Higher Regional Court of Hamm of November 30, 2017, on RWE’s responsibility for (imminent) climate damage in Peru is now almost a classic. It has been joined by the Shell judgment of the District Court of The Hague, which obliged the oil company to make CO2 reductions, and conversely the judgment of the County Court Stuttgart, which dismissed climate claims against Daimler. The climate conference in Sharm El-Sheikh 2022 decided on a climate damage fund. Does this result in new aspects for civil law dogmatics?
