More Public? Did the Pandemic Influence the Paradigm of the Labour Relations?

The object of this chapter is not to find an answer to the question of whether, after COVID-19 pandemic experiences, labour law relations are more infused by public law or private law. Such a discussion only added value seems to be the mere demonstration of the directions of the public impact of labour law. In this chapter, the author adopts a conception of the specific role of labour law, and the relationships that arise within its sphere of influence, which naturally links together domains commonly considered to be public and private. Attempts to categorise labour law (and the relationships that arise within its sphere of influence) as exclusively private or public result in cognitive errors in its analysis. The thesis of this chapter is to argue that in a time as extraordinary as a global pandemic, due to the important social role played by the work environment, there has been a noticeable increase in the publicising of the role of social relations arising within it.
