Minority Rights

Minority rights form a special category of human and fundamental rights that apply to individuals and members of specific ethnic, linguistic, religious or cultural groups. The protection of minorities involves both individual and collective aspects, as individuals may claim general human rights, while groups may claim specific rights for the preservation, development or promotion of their identity. The text examines the international and national constitutional protection of minority rights in different regions, including Europe, Asia, Australia and New Zealand, the Americas and Africa. While numerical inferiority is a necessary factor, the text emphasises that it is not the only factor in defining minorities. With regard to indigenous peoples, the text includes the definition of ILO Convention No. 169, which distinguishes them on the basis of distinct social, cultural or economic conditions and their descent from the population that inhabited the country before colonisation. The right to use minority languages is emphasised, as is the protection of minority religions and cultures, particularly with regard to land claims and economic activities. It also includes political participation and representation for minorities and indigenous peoples, both at local and regional levels and in national legislative bodies. Finally, the text advocates the inclusion of non-nationals in the protection of minorities and the need to respect the autonomy and self-identification of individuals and communities in defining their minority status.
