Liability in Transportation

The massive transportation of persons and objects takes place via recourse to the technical means of road, railway, water and air transport. Transportation is a branch of production, although owing to its peculiar features diverging from other productive activities, no new material goods proceed therefrom, since its main task is the transportation of goods itself. Transportation increases the price of material goods since the costs of carriage are included in the price of each delivered product. In the system of market-based air transport, the party paying for the carriage (the passenger or the consignor of goods) and the entrepreneur performing the carriage establish a contractual relationship, in which the legislator obligates the air carrier to adhere to its liability rigorously.
