Digital Protection of the Trademark in Jordanian Law. A Comparative Study

摘要

The study focuses light on the inadequacy of Jordanian legislation in safeguarding domain names and trademarks inside the digital realm. Various disputes have arisen, and it was found through research that trademarks are exposed to piracy by being registered first before the owner of the mark as a domain name, which is a violation of the trademark. By conducting an in-depth analysis of both domestic and global initiatives focused on safeguarding the security of domain names. In addition to the various approaches for resolving disputes between trademarks and domain names. The issue at hand pertains to the registration of national domain names and the role of ICANN, the international organization responsible for establishing public policy on the registration of international domain names. It is imperative for all parties to reach a consensus on implementing a method that effectively mitigates problems between domain name holders and trademark owners.
