Artificial Intelligence and Tort Liability

The article explores the liability for damages arising from artificial intelligence, evaluating the possibility of applying the discipline of extra-contractual liability governed by Article 2043 of the Italian Civil Code and, in particular, by Article 2050 for damages caused by the dangerous activity. Certainly, liability for damages caused by artificial intelligence can be considered governed by the legislation on defective products in relation to the manufacturer of the intelligent product, and perhaps also to the trainer of the intelligent system. This paper identifies the conditions under which it’s possible to apply the above mentioned legislation, and verifies if there is the need to approve a new specific legislation for the case of damages caused by the artificial intelligence systems.
