Article 155 [Agreements at Union Level]

First, it must be highlighted that the value of the dialogue between management and labour at Union level under Article 155 TFEU concerns precisely one of the main topics and objectives of ‘social policy’ which is also listed in the opening provision (Article 151 TFEU) of Title X of the TFEU on social policy. Such premise has to be read not only in terms of European ‘public policy’ as well as under the perspective of the increasing role of social partners at European level, but also in terms of their real impact in developing the EU system of law sources as well as under a human rights approach, since the rights to organise and to collective bargaining are recognised in the EUCFR and the most emblematic universal (ILO Conventions) and Council of Europe standards (Article 11 ECHR as well as Articles 5 and 6 of the European Social Charter).
