Article 152 [Social Dialogue]

Article 152 TFEU has its precedent in Article 118b TEEC (introduced by the 1986 SEA): ‘The Commission shall endeavour to develop the dialogue between management and labour at European level which could, if the two sides consider it desirable, lead to relations based on agreement’. From this new legal basis and in contrast to the Treaty of Rome (which included labour and management only via the Economic and Social Committee), it has been held that the SEA resurrected the social dialogue process. The drafting of Article 118b TEEC itself was an example of the fruits of social dialogue in the framework of the Delors Commission.
