Article 114 [Harmonisation in the Internal Market]

Article 114 TFEU authorises the Union legislator to adopt measures harmonising national laws and regulations that have as their object the establishment and functioning of the internal market. It is supplemented by Article 115 TFEU, which allows for the approximation of national provisions directly affecting the internal market. It tries to strike a balance between the establishment of an internal market with uniform law and the regulatory autonomy of the MS and their specific legal orders. Approximation therefore leads to converging rules in the MS but allows for certain specificities. To this end, national derogations are admissible under strict circumstances and under the strict control of the Union.
