Article 97 [Reasonable Frontier Crossing Charges]

Article 97 TFEU ensures that charges levied by carriers due to frontier crossings are not unreasonable. The focus of this provision is not on the general concept of charging for a frontier crossing, but on the carrier being prevented from overcharging users of their service when they incur costs associated with crossing a frontier. The provision is aimed at both undertakings and MS. The provision supplements Article 30 TFEU, which governs the elimination of customs duties by reason of crossing a frontier. Article 97 TFEU replaces its predecessors of Article 81 TEEC and Article 77 TEC. The changes from TEEC to TEC to TFEU are, however, merely semantic and therefore altered nothing in substance.
