Article 96 [Forbidden State Aid and Exceptions]

Article 96.1 TFEU prohibits MS from imposing rates or conditions involving any element of support or protection in the interest of one or more undertakings or industries. The prohibition applies to transport operations carried out within the EU and is not absolute as the Commission has the ability to authorise the imposition of such rates or conditions by MS as it sees fit.
