Article 95 [Prohibition of Discrimination]

Article 95 TFEU creates a special prohibition against discriminatory carriage rates and conditions based on the destination or origin of the goods in question. This prohibition is, in essence, a restatement of the general prohibition of discrimination on the ground of nationality under Article 18 TFEU, but with a particular focus on carriage of goods. Article 95 TFEU also provides a specific complement to Articles 28 to 37 TFEU, which govern the free movement of goods regime within the EU.
