Article 92 [Standstill Obligation]

Article 92 TFEU contains a so-called “standstill provision” addressed to the MS. It allows MS to maintain the discrimination (differential treatment) existing (“freezing the situation”) at the date of their accession to the Union, between their national carriers and the carriers established in other MS, but it forbids any aggravation of such discrimination after this date. It is a specific formulation of the commitment of loyal compliance pursuant to the Union goals in Article 4.3 TEU and a specific application of the discrimination ban in Article 18 TFEU.
