Article 109 TFEU [Implementation]

Article 109 TFEU allows the Council to enact implementing regulations. This provision requires the Council to adopt regulations acting by a qualified majority on a proposal from the Commission and by consulting the European Parliament. In practice, Article 109 TFEU allows for the adoption of regulations which allow certain measures may be exempted from the obligation to notify. Although the Council has discretionary powers, it does not often use this power.
