Article 108 [Enforcement]

The central provision for the enforcement of EU State aid law is Article 108 TFEU. Article 108.1 TFEU provides the Commission with the power to review all systems of aid. Article 108.2 TFEU confers the Commission with a discretionary power to declare aid granted by the MS compatible with the internal market. Article 108.2 TFEU also enables the Commission to open a formal investigation (➔ para 24 et seqq.), in case it has serious doubts about the compatibility of State aid measures.
