Article 131 [Compatibility of National Legislation]

This provision deals with the requirement of the legal compatibility of national legislation with central bank independence (Article 130 TFEU and Article 7 of the ESCB Statute) and the provisions of the Treaties and the Statute. Underlying this obligation of the MS to ensure national legal compatibility with the Treaties and the Statute is the settled case law of the European Court of Justice (ECJ) stating that the Treaties and the law adopted by the EU on the basis of the Treaties have primacy over the law of MS, under the conditions laid down by the said case law, as well as the principle of sincere cooperation (Article 4.3 TEU).
