Unabhängiges BSI – Eine rechtliche Betrachtung der politischen Unabhängigkeitsforderungen

For years, there have been repeated calls in the political arena for the Federal Office for Information Security to become independent as the central German federal cyber security authority. This article explains the background to these demands, examines various models for the independence of authorities in Germany and highlights the constitutional problems associated with the independence of authorities. At the end, alternative solutions are presented that avoid these constitutional problems and still effectively address the initial issues behind the political demands.
