From Legislation to Enforcement: Tackling Digital Acquisitions in the Gulf Region

This article examines the evolving landscape of digital acquisitions in the Gulf Region and, only occasionally, Egypt, highlighting the necessity for competition law to adapt to the complexities of digital markets. It reviews traditional competition law objectives, emphasizing the need for a nuanced understanding of economic efficiency, consumer protection, fairness, and broader societal issues. By analyzing the definitions and characteristics of mergers and acquisitions, the article identifies the unique aspects of digital mergers, such as network effects, user lock-in, and data privacy concerns. Therefore, the Gulf countries should consider other jurisdictions’ standards to enhance their competition laws and effectively regulate the implications of digital mergers on market dynamics and innovation. In the meantime, related national legislation may also provide valuable assistance. Finally, it advocates for a cohesive regulatory framework that addresses these digital-specific challenges.
