Liberal democracies are in a state of democratic self-alienation due to multiple crisis events and the advance of authoritarianism. The usual crisis narratives often mischaracterize political realities as problems, that can be solved in the short term. The responsive constitution—together with EU law—can provide normative answers to these problems, by acknowledging the individual in his or her fundamental rights. European (constitutional) courts are important actors in this process which convey this responsiveness of law in the necessary contexts.
