The Ethiopian Perspective on the Civil Law Consequences of Corruption in International Contracts

Corruption hinders international business transactions, leading to the adoption of anti-corruption criminal law treaties and national legislation. However, fighting corruption requires collaboration from other areas of law to achieve joint objectives. This article explores the enforceability of international bribery contracts and international commercial contracts obtained through bribery in Ethiopian law. It also explores the issue of punishment for wrongdoers who are not granted restitutionary remedies after fulfilling their obligations. The article notes that Ethiopia’s anti-corruption laws govern the criminal consequences of corruption, but there are no laws in Ethiopia containing explicit legislative regulations addressing the civil law implications of corruption. Therefore, only the general rules of the Ethiopian Criminal Code regarding civil liability resulting from criminal offences and the Ethiopian Civil Code regarding contracts and the pertinent special laws governing public contracts are applicable.
