<p>Article 2(a) of Directive 2001/29/EC of the European Parliament and of the Council of 22 May 2001 on the harmonisation of certain aspects of copyright and related rights in the information society must be interpreted as meaning that the critical edition of a work which is in the public domain, the purpose of which is to restore the text of that work with comments and the requisite critical apparatus, may be regarded as a work protected by copyright, within the meaning of that provision, provided that it is an intellectual creation reflecting the author’s personality, as an expression of his or her free and creative choices, and that it can be identified with sufficient precision and objectivity.</p>
