The act of “evocation” prohibited by Art. 13(1)(b) of Regulation (EU) 1151/2012 has to pertain to a characteristic that in any case also alludes to the geographical origin of the product, which is what is specifically protected by Art. 13 of the Regulation.

The protection granted by the provision in question cannot extend to the exclusive use of individual non-geographical, generic, or common terms (here: the words “aceto”, “balsamico” or “aceto balsamico”), as this would give the party registering those terms a monopoly over them.

The object and scope of protection of Art. 13(1)(b) of Regulation (EU) 1151/2012 is not so much the product as a whole but solely the geographical term of the registered name (here: the toponym “Modena”).
