“Kalamata Olives”

For the purpose of applying the provisions of Arts. 6(2) and 42 of Regulation No. 1151/2012 and circumscribing the coexistence of a name of a plant variety and a protected designation of origin (here: Kalamata), it suffices to establish the actual use of a certain name of plant variety, irrespective of any official registration thereof in a special catalogue of varieties, as registration is irrelevant for the purpose of those provisions inasmuch as the aforesaid Regulation makes no such distinction.
