If the original work or its copies are directly imported into the country without being made available for trade through sale or other means in a foreign country, and ownership or the right of disposal is subsequently transferred, they are subject to the provisions of the proviso in Art. 20 of the Copyright Act and the determination of whether the distribution right has been exhausted should be made accordingly. If the original work or its copies, which are made available for trade through sale or other means in a foreign country with the permission of the copyright holder, are re-imported and distributed domestically, the effect specified in the proviso to Art. 20 of the Copyright Act is recognized unless there are special circumstances.
