Regional laws are precluded from establishing marks that attest at the same time to the quality and geographical origin of products and thus have restrictive effects on the free movement of goods in breach of European legislation. For an obstacle to the process of harmonizing trade marks and distinctive signs for the protection of goods and services to exist, the national region would have to create actual quality marks or even only measures having an effect equivalent to the restriction on imports, as referred to in Arts. 34 and 35 TFEU.
