Research on the convergence mechanism between administrative law enforcement and criminal justice in anti-doping work in China

With the promulgation and implementation of the Judicial Interpretation of Doping and the Amendment to the Criminal Law (XI), the difficulty of the convergence between administrative law enforcement and criminal justice in anti-doping work has become increasingly prominent in practice. By discussing the diversity of the subjects of the convergence mechanism between administrative law enforcement and criminal justice and its legitimacy in jurisprudential terms, this paper analyzes the current situation and difficulties of the convergence between administrative law enforcement and criminal justice in China’s anti-doping work from the aspects of legislative, law enforcement, evidence and responsibility convergence, and integrates the typical experience of the convergence in other fields of our country. From the aspects of the legislative, law enforcement, evidence, responsibility, and information convergence and procuratorial supervision, this paper provides feasible ideas for the construction of administrative law enforcement and criminal justice convergence mechanism in anti-doping work.
