Von der Defensive zur Cyberoffensive? Aktive Cyberabwehr, Hackbacks und der Diskurs der Akteure in der deutschen Cybersicherheitspolitik

This article examines the German cyber security policy debate on active cyber defence from a constitutional and international law perspective. The actors’ discourse is reconstructed to determine who should receive an active cyber defence mandate in the case of a cyber-attack below the level of an armed conflict. Legal issues and possible risks concerning active cyber defence measures will be addressed to show the consequences for international relations and international security policy.
