Die Vollstreckung der Freiheitsstrafe

The execution of a prison sentence affects not only the sentenced person, but also their children, partners and other family members. They are not only affected de facto by the execution of the prison sentence, but also in legal positions protected by fundamental rights. These legal positions must be reconciled with the state’s claim to punishment. Against this backdrop, the article looks at the regulations in the law on the execution of sentences as well as the joint accommodation of mothers with small children and prison visiting rights.
