‘Outsourced’ competition enforcement – the experience of the Hungarian Competition Authority

This article examines the experience of the Hungarian Competition Authority with cross-border competition enforcement under Article 22 (1) of Regulation 1/2003. Key challenges include procedural differences, language barriers and legal professional privilege rules, which complicate mutual assistance. The article further deals with IT-related issues, such as data access, integrity and the transmission of evidence between competition authorities. The GVH underscores the need for greater harmonisation of procedural laws and LPP rules across the European Union (EU) to ensure uniform and effective competition law enforcement. The study advocates for clearer, union-wide regulations to address jurisdictional differences, streamline cooperation, and mitigate legal uncertainties in decentralised competition law enforcement.
